Acceptance of terms

Cookingmode provides the Services defined below to You subject to the following Terms of Service ("TOS"), which may be updated by Cookingmode from time to time without notice to You. You can review the most current version of the TOS at any time at: http://www.cookingmode.net/terms/. By accessing and using the Services, you accept and agree to be bound by the terms and provision of the TOS. The TOS are applicable to all offers, contracts and Services provided by Cookingmode to You.

Service description

1. Cookingmode supplies a variety of online database based Services to You. The Services allows You to create a personal profile, add Content to the site through comments, new recipes and pictures. You can also create your own collections with Content from the Cookingmode database. There is no limit to the number of recipes and collections You may create. However, Cookingmode does reserve the right to impose a limit at any time if this functionality is abused. If a limit is imposed it will be communicated through the website.

Your registration obligations

By registering with Cookingmode, You represent that You are of legal age to form a binding contract and that You have read and understood these TOS.

You agree to ensure all Content uploaded to the site by You, including but not limited to comments, recipes and pictures, is appropriate to the site and not in anyway offensive or abusive to other users of Cookingmode or Cookingmode itself. Cookingmode retains the right to remove any Content provided by You if the Content is deemed inappropriate. Inappropriate Content includes, but is not limited to: racist, sexually graphic, swearwords or offending remarks. Cookingmode may refuse any further Content from You if your Content was deemed inapproriate at any time.

Cookingmode use of content

By uploading Content to Cookingmode You allow Cookingmode to use the Content in overviews, updates, geographical maps and other lists. Personal information is explicitly excluded from this use and will not be used in anyway. No Content will be traceable to You, unless You specifically allow this.

Using recipe information from other sources

The Cookingmode website allows You to create an online recipe book with recipes from different sources. This includes recipes from other websites, books and magazines. Those recipes may be copyright protected and may not be published on other websites (like Cookingmode) without prior approval of the copyright owner. If you wish to use recipes from other sources and make them publicly available in your recipe book, You agree to seek prior approval of the recipe copyright owner before doing so. If You fail to do this, or the recipe copyright owner does not give approval for it, You agree to set the access level to the recipe to private only, which means only You can see the recipe in your recipe book. Cookingmode reserves the right to enforce a private access level to recipes, if a recipe copyright owner files a complaint with Cookingmode about public access level to a recipe he or she owns the copyright of.

Data storage

All Content, as well as personal information and other website data managed by Cookingmode resides in data centers in the Netherlands.

Privacy statement

Cookingmode stores certain personal information of You during your use of the Services. This information is only used for the following purposes:

1. Cookingmode stores the IP address and time of visit for each page visit for statistical purposes. This data is not accessible to others and will never be shared with third parties.
2. Personal information entered when sending a message, adding a comment or uploading a picture is only used for those purposes. Information will not be shared with third parties.

Cookingmode uses cookies to store various information on your computer with the purpose of improving the browsing experience. Information stored in cookies will only be used by Cookingmode and will not be shared with third parties. The setting of cookies can be prevented by not selecting the respective checkboxes, except for cookies storing authentication tokens.

Cost of Services

The free Membership is the default Membership when You first register for Cookingmode. This Membership comes without cost to You. Cookingmode reserves the right to introduce a paid membership level for additional services at any point in time.

Duration, termination and renewal

The free Membership has no duration and can be used by You without time limit. The free Membership can be terminated at any time by You, for any reason without notice.

Complaints

You can report complaints to Cookingmode through the contact page on the website, or through the emailaddress mentioned in this TOS, clearly marked as a complaint, fully described and documented. Cookingmode will confirm and answer every complaint to You by email (provided You are registered with Cookingmode and have provided a valid and current emailaddress) within 14 days of receiving the complaint. Handling of every complaint will remain confidential between You and Cookingmode, unless otherwise agreed. If a complaint cannot be resolved within a reasonable amount of time, You and Cookingmode have the right to take legal action. All Cookingmode Services, the TOS and all complaints are covered solely by Dutch law and regulations.
